when majority rules...

11.12.2004

what happens to the minority? Absolute democracy demands that law follow majority desire. Perfect democracy should protect the rights of the minority(ies). That's what the judicial branch is for: to protect civil liberties from unconstitutional laws. That's why judges are not elected: to protect the justice system from absolute democracy. But if the majority gets too powerful... if they are able to promote the appointment of judges with deep biases... what happens to the protection the Constitution is supposed to provide?

I've been thinking about these things because I read Eric Meyer's post: Behind The Beauty, Cracks Appear, and because I've been feeling much the same way as he. And I feel that the recent election has shown just how politically polarized we are as a nation, and that it's left me and many around me asking, "Wait - just because we amount to 49% and not 51% - we don't count?"

I'm sending this out to various friends, partly because I know that politically you're all over the map. Your thoughts?
